Day 100: Blue Dye in the River

At a hearing in an environmental court in Calamba, Laguna, Francis (A), a young lawyer for a fishing village, cross-examines Lauro (B), operations manager of a dyeing plant accused of discharging into the river, before Judge Ivy (C), who must decide on a temporary order, while Lydia (D) defends the company.

    Kayo po ang operations manager ng planta. Totoo po bang nagdi-discharge kayo sa ilog tuwing hatinggabi?

    You're the plant's operations manager. Is it true that you discharge into the river every night at midnight?

    Hindi po. Dumadaan po sa treatment facility ang lahat, within DENR standards.

    No. Everything goes through the treatment facility, within DENR standards.

    Counsel, saan po galing ang "tuwing hatinggabi"? Sana po may basehan, hindi tsismis sa pampang.

    Counsel, where does "every night at midnight" come from? I'd hope there's a basis, not riverbank gossip.

    Iyan nga po ang objection namin, Your Honor: assumes facts not in evidence.

    That's precisely our objection, Your Honor: assumes facts not in evidence.

    Nasa record po ang mga affidavit ng labing-apat na mangingisda. Sabi po ng isa: "Malinis daw ang ilog, kaya pala asul ang mga isda."

    The affidavits of fourteen fishermen are on record. One of them says: "The river's clean, they say. So that's why the fish are blue."

    Overruled. Pero, Counsel, hindi po marunong mag-testify ang isda. May lab result po ba kayo?

    Overruled. But, Counsel, fish can't testify. Do you have a lab result?

    Exhibit C po, sampling ng LLDA noong Marso, alas-dos ng madaling-araw. Mr. Witness, bakit po lampas sa limit ang color at COD?

    Exhibit C, the LLDA's sampling in March, at two in the morning. Mr. Witness, why were the color and the COD over the limit?

    Ah, 'yon po, ano kasi, nag-bypass 'yung system that night, nasira 'yung pump, pero one-time lang po 'yon, I swear!

    Oh, that, well, the thing is, the system went on bypass that night, the pump broke, but that was a one-time thing, I swear!

    Move to strike po, Your Honor! Hindi po competent ang testigo sa usaping teknikal.

    Move to strike, Your Honor! The witness isn't competent on technical matters.

  10. C

    Denied. Ngayon lang po luminaw nang ganito ang tubig sa kasong ito.

    Denied. This is the first time the water in this case has been this clear.

  11. A

    Wala na po akong tanong. Hinihiling po namin ang TEPO, cease and desist habang dinidinig ang kaso.

    No further questions. We ask for a TEPO, cease and desist while the case is being heard.

  12. C

    Granted. Wala pong discharge sa ilog hanggang matapos ang kaso. Sana po, bumalik na sa dating kulay ang mga isda.

    Granted. No discharge into the river until the case is over. And let's hope the fish go back to their normal color.
